Thank you for registering your Solaris 10 systems. This is your entitlement document. This document is your proof of license for Solaris 10; please print it and keep it in a safe place. You can also view translated versions of a generic entitlement document.
If you change the systems on which you have Solaris 10 installed, you must update your registration. The entitlement only provides rights to use Solaris on registered systems.
THIS ENTITLEMENT EVIDENCES YOUR AUTHORIZED SCOPE OF USE UNDER THE TERMS OF THE SUN MICROSYSTEMS, INC. SOFTWARE LICENSE AGREEMENT FOR THE SUN SOFTWARE INDICATED BELOW (THE SLA) UNLESS OTHERWISE AGREED IN WRITING BETWEEN YOU AND SUN MICROSYSTEMS, INC. (SUN). Capitalized terms not defined in this document have the meanings ascribed to them in the SLA. These terms will supersede any inconsistent or conflicting terms in the SLA.

Solaris 10 Operating System, 3/05, 1/06, 6/06, 11/06, 8/07, 5/08, 10/08, 5/09, & 10/09 update releases
Permitted Use: You may use Solaris only in one of the following ways: (1) if you have obtained a system from Sun or one of Sun’s partners that includes a license for Solaris, you have a perpetual right under that license to use only the version that was installed on the system (no right to use updates, or upgrades to Solaris is included unless you acquire a service plan that includes this right); or (2) under a valid, existing license for Solaris and properly acquired Sun service plan that includes rights to updates or upgrades to Solaris; or (3) under the trial use terms below to which you must agree before downloading Solaris.
License Term: Perpetual (subject to termination under the SLA)
Licensed Unit: Registered Computer System
Additional Terms:
1.0 License to Develop. You are authorized to develop software programs utilizing Software. If you desire to develop software programs which incorporate portions of Software (“Developed Programs”), the following provisions apply:
(i) you may not modify or add to application programming interfaces associated with Software;
(ii) you are not licensed to use fonts within Software to develop printing applications unless you have secured valid licenses from the appropriate font suppliers;
(iii) incorporation of portions of Motif in Developed Programs may require reporting of copies of Developed Programs to Sun; and
(iv) you will indemnify and defend Sun and its licensors from any claims, including attorneys’ fees, which arise from or relate to distribution or use of Developed Programs to the extent these claims arise from or relate to the development performed by you. This Section 1.0 does not apply to the Sun GlassFish Enterprise Server, Sun GlassFish Message Queue (formerly known as Sun Java System Message Queue), Sun Directory Server, and Java 2 Platform, Standard Edition (“J2SE”) included in or bundled with the Software. In addition, J2SE that is included in or bundled with the Software is subject to the Sun Software License Agreement and the free use Entitlement for the Java Standard Edition Development Kit found in the /usr/java/ directory, which contains, among other things, use limitations for J2SE in embedded applications.
2.0 No Diagnostic, Maintenance, Repair or Technical Support Services. The scope of Your license does not include any right, express or implied,
(i) to access, copy, distribute, display or use the Software to provide diagnostic, maintenance, repair or technical support services for Sun software or Sun hardware on behalf of any third party for Your direct or indirect commercial gain or advantage, without Sun’s prior written authorization, or
(ii) for any third party to access, copy, distribute, display or use the Software to provide diagnostic, maintenance, repair or technical support services for Sun software or Sun hardware on Your behalf for such party’s direct or indirect commercial gain or advantage, without Sun’s prior written authorization. The limitations set forth in this paragraph apply to any and all error corrections, patches, updates, and upgrades to the Software You may receive, access, download or otherwise obtain from Sun.
3.0 Records and Documentation. During the term of the SLA and Entitlement, and for a period of three (3) years thereafter, You agree to keep proper records and documentation of Your compliance with the SLA and Entitlement. Upon Sun’s reasonable request, You will provide copies of such records and documentation to Sun for the purpose of confirming Your compliance with the terms and conditions of the SLA and Entitlement. This section will survive any termination of the SLA and Entitlement. You may terminate this SLA and Entitlement at any time by destroying all copies of the Software in which case the obligations set forth in Section 7 of the SLA shall apply.
